IMPORTANT NOTICE TO CUSTODIANS
RECEIVING IV-D CHILD SUPPORT SERVICES

Effective October 1, 2007, in accordance with the Deficit Reduction Act of 2005, Public Law 109-171 and Chapter 425 of the Nevada Revised Statutes, the Division of Welfare and Supportive Services shall impose an annual $25 fee for each child support case in which the custodian has never received public assistance and the state has collected at least $500 in child support during the federal fiscal year, October 1st to September 30th.

What cases will have the annual $25 fee imposed?
If the custodian never received public assistance and the court ordered child support obligation is collected and disbursed through the Child Support Enforcement Program.

When a custodian has multiple child support cases, is the annual $25 fee per case or per custodian?
Per case. The federal law states the $25 annual fee is to be imposed for each child support case. If the custodian has multiple cases for multiple obligors, the fee will be imposed and collected multiple times.

Was any notification provided to custodians?
A post card-sized mass mailer is being sent to all custodians who currently have open child support cases and have never received public assistance. The September JP Morgan Debit Card statement will include fee information. We will also be adding informational links to the Child Support Enforcement website.

Which Federal and State laws require this annual $25 fee?
The Deficit Reduction Act of 2005, Public Law 109-171 and Chapter 425 of the Nevada Revised Statutes, give the Child Support Enforcement Program authority to withhold this fee.

How will the annual $25 fee be collected?
Each year, for each case, the annual $25 fee will be deducted from the child support payment, once $500 has been collected and disbursed by the Child Support Enforcement Program during the federal fiscal year, October 1st through September 30th.

Which state charges the fee when the custodian lives in one state and the noncustodial parent lives in another state?
The state which initiated the child support case (usually the state where the custodian lives) is responsible for collecting the fee.

Will the noncustodial parent get full credit even though $25 has been deducted from my child support payment?
Yes. Federal law requires that the noncustodial parent receive full credit even though the annual fee has been deducted from the payment.
