Water Rights Dedication Requirements
Water, being an invaluable resource, essential to the existence
of life and paramount to the future growth of Churchill County, must be
preserved and the impact on its diminishing availability, minimized. In
1903, the United States Congress authorized the Newlands Project. Subsequent
federal decrees on the Carson and Truckee Rivers secured water rights
that have allowed and enhanced this community's growth. The intent of
this ordinance is to protect this natural resource for future generations.
To receive a building permit, water rights MUST be dedicated
to Churchill County or a payment in lieu of dedication may be accepted
if there are no water rights appurtenant to the parcel at the time the
building permit is applied for.
The quantity of water rights required to be dedicated will be determined
by the following table unless otherwise required by the Board of County
Commissioners or the State Engineer:
Use Acre Feet
Single family residential (per dwelling)
- Domestic well 2.02
- Community water supply 1.12
Multi-family residential (per unit)
Minimum dedication of 2.02 AF 0.30
Commercial & Industrial
- Per fixture unit as defined in the Uniform Plumbing Code 0.028
- Minimum dedication of 2.02 AF
Submit a quitclaim deed to Churchill
County Planning Department with a map (prepared by a licensed water right
surveyor) showing where the dwelling will be and where the water rights
will be removed.
If there are no water rights appurtenant to the land, the applicant may
pay an amount of cash equal to one and one half (1 1/2) times the fair
market value of water rights required for dedication in lieu of the requirements
set forth above. Fair market value is established by resolution of the
Board of County Commissioners. The current value established on September
24, 2004, is $ 629 per acre-foot x 2.02 AF x 1.5 = $ 1,905.00 per dwelling.
