Public Services

All records are indexed by the names of the principal parties on the document and by the year recorded. All records are open for public inspection and can be purchased by the general public for $1.00 per page. Some documents can only be purchased as a “certified” copy. Recorded documents are on microfilm and are available for public viewing. There is no charge for customers to search the indexes or view the documents on site.

Total Fees collected 2007 calendar year were $745,139.00.

Real Property

The office collected $445,190.30 this fiscal year on real property transfer tax at the time of recording and disbursed quarterly to the Nevada State Controller who in turn disburses monies to the various entities.

Financing Documents

The deeds of trust, notices of default/breach, reconveyances, Uniform Commercial Code (UCC) financing statements, security agreements, etc., are recorded and cross-indexed in this office. A separate computer indexing is maintained for UCC filings as they are governed by a different NRS than the other official recordings. Searching of UCC financing statements, federal tax liens and judgments are the only allowed searches that can be performed by recorder personnel.

As of July 1, 2001 UCC Financing Statements except those dealing with Real Property are recorded in the Nevada Secretary of State Office. A search request can be done by our office, but an additional search will need to be done at the Secretary of State UCC Division.

The National UCC Financing Statement is the standard form. Any other form, including the previous Secretary of State form will not be accepted. Security Agreements that are received in this office will be considered a document, not a Commercial code filing and will be charged the fee used for official records.

Maps

Subdivision, parcel maps, surveys, land division, annexation maps, planned unit development, and reverted maps are recorded and cross-indexed. All requirements for each map are verified prior to recordation by the planning/drafting department and the assessor's office except for survey maps. Computer indexing of all county maps from 1904 to current. Maps are indexed by Township/Range/Section to benefit the public as there have been instances when a certain area needs to be surveyed and the recorded maps have helped establish existing property boundaries. 

When a surveyor has made an error on a recorded map, he records a certificate of amendment, which is then referenced on the map it pertains to and is indexed in the computer system. Due to the fact that the county does not have a county surveyor, the Recorder's Office offers an administrative solution for reproducing copies of original maps, etc., at a very minimal cost. Paper copies of recorded maps (24"x36") can be obtained from the Recorder's Office for $3.00 per sheet.

Unpatented Mining Claim Records

Notices, certificates of location, mining maps, affidavits, and notice of intent to hold, and proofs of labor forms are recorded and cross-indexed by owner/locator, name of claim, and by Township/Range/Section on the mining maps. After recording of certificates of location and the mining maps are completed, they are plotted on the Mining MT Plats which are kept current in the office. Annual assessment work (affidavits and notice of intent to hold, and proofs of labor) are required by law to be recorded in the Recorder's Office by November 1st, 12 noon annually. The recorder collects and disburses mining fees quarterly to the Nevada State Department of Minerals ($6.50 per claim) on certificates of location and annual assessment work.

The Nevada State Division of Minerals increased their fee an additional $2.00 on July 16, 2001. On October 1, 2001 an increase of $1.00 was approved by the Nevada Legislature to be disbursed to the Recorder. This will bring the cost of annual assessment work to $8.50 per claim plus the $4.00 document fee enacted by Legislature. These forms have been changed to meet the new recording criteria so that miners will not have to pay the additional $25.00 non-standard fee.

Military Discharge Papers

The County Recorder provides an important service for veterans. Military discharge papers are recorded, free-of-charge, so that certified copies can be obtained by veterans for benefits such as VA loans, educational benefits, property tax exemption, medical and death benefits. The military has a record of a veteran's service, but it is time consuming to obtain copies through the military. Veterans that live in our county can safeguard this important information by recording; it then becomes a permanent public record, easily obtainable and free-of-charge. Military Discharges have been indexed in the AS400 database from 1894 to current for efficient accessibility. See Assessor’s office to find out if you qualify for a military exemption.

Declaration of Homestead

Under Nevada law, homeowners may record a Declaration of Homestead to protect their residence against certain claims. This law can be found in Chapter 115 of Nevada Revised Statutes. Marriage Certificates

After a couple has completed the marriage ceremony, the minister, Justice of the Peace, etc., is required by law to provide the recorder's office with the marriage certificate within 10 days which is then recorded. A certified copy of the marriage certificate can be obtained from the county where the marriage license was purchased at a current cost of $10.00. In order to change the bride's driver's license and social security information a certified copy must be obtained.

Affidavit of Marriage Correction
If a mistake is made on the original marriage certificate and the document is recorded, the error can be corrected by completing an Affidavit of Marriage Correction which is provided by our office. The cost for a correction has increased to $25.00 per legislation enacted in 1999. A notice has been implemented by our office to be included with the marriage certificate at the time of purchase for the Minister. We hope this will eliminate the necessity of recording the Affidavit of Marriage Correction. If the only errors to be corrected on the certificate of marriage are clerical errors that were made by the county clerk, no fee will be charged. In this county the only instance where a clerk would fill out the information would be if the couple was married by the Justice of the Peace.

Lost or Destroyed Marriage Certificate
If a marriage certificate has been lost or destroyed by the person solemnizing the marriage, he can go to the county clerk's office and request a replacement certificate. The County Clerk in Churchill County charges $6.00 for the preparation of an affidavit of loss or destruction and issuance of the replacement marriage certificate. They will give the customer the form to take down to the Recorder's office. The Recorder's office will charge $19.00 ($14 recording fee and $5 certification fee).

Scanning/Microfilming

Recorded documents are scanned and microfilmed as a permanent record and the original document returned to the customer after filming. All records are indexed by the names of the principal parties on the document and by the year recorded. The records are open for public inspection. In 1994 we began to optically reduce all recorded maps which enables the customer to purchase a 8½" x 11" copy of a map vice the usual 24" x 36" map at the same cost.

In January, 2002 we began to scan the documents that are recorded in our office. This will allow the public to view documents "in house" on the PC computers available in our office. It will not allow viewing of documents on screen for any documents previous to 2002.

At this time we can only offer official record CD on documents 2007 forward.  We’re   working on processing prior records to CD; but this involves the redaction of personal information from the documents prior to placing on CD.  The fee is based on how many images are on the CD x 5 cents per image.  I foresee us as having 2000 to current available in the next 2 years.

Recorded documents are on microfilm and are available for public viewing. There is no charge for customers to search the indexes or view the documents.

Printouts of Recorder’s Official Records

Printouts of indexes, or generated reports with specific information can be purchased from the recorder's office for 25 cents per printout sheet. We currently provide information to Collection Agencies, Nevada State Vital Statistics, and Nevada State Welfare Investigations & Recovery on a monthly basis, title companies and the public upon request.

County Newspapers

The County Recorder's Office was responsible for obtaining microfilm of newspapers per the Nevada Revised Statutes. This responsibility now lies with the Public Library. Microfilm on reel is available for public use at the County Library and ranges from 1903 to current. The microfilm was transferred July 1995 to the library for easier accessibility by the public.

The local newspaper does not keep back copies of their newspaper, so the Public Library provides an important function for our community.
