"Personal Information" Defined

NRS 603A.040  “Personal Information” defined.  “Personal Information” means a natural person’s first name or first initial and last name in combination with any one or more of the following data elements, when the name and data elements are not encrypted:

  1. Social security number.
  2. Driver’s license number or identification card number.
  3. Account number, credit card number or debit card number, in combination with any required security code, access code or password that would permit access to the person’s financial account.

* The term does not include publicly available information that is lawfully made available to the general public.

Court Documents

Court "filed" documents will require a cover page  as the file stamp is in the right corner of the first page. These documents require an original signature or must be a "certified" copy with the seal on the last page of the document to record. If a court filed document has attached an Affidavit to the back, it must be referenced in the court document and have the certification from the court; otherwise it will be treated as a separate document with a cover page and will be charged the recording fee. Court "filed" documents are exempt from the nonstandard fee if they conform to the formatting requirements established by the court. In most cases, the affidavit has not been filed with the court and will not have a certification stamp and seal; so the standard formatting requirements will apply. Click here to download form(s).

NRS 17.150 Section 4 (b) requires a judgment creditor who records a judgment or decree to record an affidavit stating the debtor’s driver’s license and state of issuance or the judgment debtor’s social security number; and (c) the judgment debtor’s date of birth, if known to the judgment creditor. This NRS should be used when recording an affidavit to fill in the SSN affirmation statement. Click here to download form(s).

Death of joint tenant/community property with right of survivorship

Form – Affidavit of Joint Tenant can be obtained from most office supply stores in the State of Nevada.

Social Security Affirmation statement should state these specific laws.
NRS 40.525 Section 5 Allows the termination of interest of the deceased person, it title or an interest in real or personal property held in joint tenancy or as community property with right of survivorship is affected by the death of a joint tenant or spouse, any person who has knowledge of the facts may record in the office of the county recorder where the property is situated an affidavit meeting the requirements of NRS 111.365 accompanied by a certified copy of the death certificate of the deceased person.

NRS 440.380 Sec 1.(a) Medical certificate of Death; contents.
The person who signs the medical certificate shall specify: (b) The social security number of the deceased.

Recording a “certified” copy? 

A “certified” copy can be recorded IF NO ADDITIONAL INFORMATION HAS BEEN ADDED TO IT. It is no longer considered a certified copy if it has been written on.

Legibility Notice

Per NRS 247.102(3) the County Recorder can accept a document conditionally, subject to submission of a suitable copy at a later date; if the Legibility Notice is signed and attached to the back of the document that is to be recorded. Upon submission of a suitable copy at a later date, they will be required to pay recording fees again. Click here to download form(s).

Nevada Revised Statute 111.312.1

Requires the name of grantee or person recording to be placed on document prior to recording for the following TYPES of documents: Notice of Completion, Declaration of Homestead, lien or notice of lien, or any conveyance of real property or instrument in writing setting forth an agreement to convey real property. Assessor Parcel number must appear on the top of the above mentioned documents. We would prefer that you place in top LEFT as we place our recording number in the top right on each document. We are not required to check the accuracy of the APN and the Assessor parcel should not be deemed as a complete legal description on any conveyance.

Nevada Revised Statute 328.110

NRS 328.110 Conditions for recording conveyances where the United States is grantee; protection of subsequent purchaser.

A Recorder of conveyances of real property in this state shall not accept for recordation any deed of conveyance wherein the United States is the grantee unless there is recorded with the deed of conveyance the written statement of a representative of the United States, contained in the deed, or a notarized statement by such a representative accompanying it, that the United States does not seek exclusive jurisdiction over the property.
